RESOLUTION NO. 2000-34 <br />RESOLUTION OF THE SOUTHERN CALIFORNIA PUBLIC POWER <br />AUTHORITY AMENDING RESOLUTION NO. 2000-27 <br />RELATING TO THE MAGNOLIA PROJECT <br />WHEREAS, The Board of Directors adopted its Resolution No. 2000-27 <br />creating the Magnolia Power Project as a Study Project of the Authority on October 19, <br />2000; and <br />WHEREAS, Section 5 of Resolution No. 2000-27 provides for Study <br />Participants to share the costs of the study; and <br />WHEREAS, the Board of Directors desires to clarify when the Study <br />Participants begin to share such costs. <br />NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE <br />SOUTHERN CALIFORNIA PUBLIC POWER AUTHORIN DOES HEREBY RESOLVE, <br />DETERMINE AND ORDER: <br />1. That Section 5 of Resolution No. 2000-27 is hereby amended to read <br />as follows: <br />"5. That members who desire to participate in the Study Project notify <br />the Executive Director by letter not later than December I, 2000, of <br />their desire to participate, the level of such participation (by number of <br />megawatts), and their agreement to pay pursuant to the Planning <br />Agreement their proportionate share of the costs of the Study Project." <br />2. That Section 11 is added to Resolution No. 2000-27 to read as follows: <br />"That in the event of a conflict between the provisions of this <br />Resolution and the provisions of the Planning Agreement, the <br />provisions of the Planning Agreement will control." <br />3. This Resolution shall take effect immediately.
