RESOLUTION NO. 2004-37 <br />RESOLUTION OF THE SOUTHERN CALIFORNIA PUBLIC <br />POWER AUTHORITY AUTHORIZING SCPPA TO <br />UNDERTAKE VARIOUS COORDINATED PROGRAMS <br />FORMERLY CARRIED FORTH BY THE SOUTHERN <br />CALIFORNIA PUBLIC POWER POOL (SCUPP) AND <br />PROVIDING FOR ADDITIONAL CONTRIBUTIONS TO THE <br />AUTHORITY'S REVOLVING GENERAL FUND, AND <br />TAKING CERTAIN RELATED ACTION <br />WHEREAS, the Southern California Public Power Authority (the Authority) <br />owns interests in various generation and transmission projects, the output of which has <br />been sold to Members of the Authority; and <br />WHEREAS, the cities of Burbank, Glendale, Los Angeles, and Pasadena <br />are parties to the Power Coordination Agreement, which established the Southern <br />California Utility Power Pool ("SCUPP"); and <br />WHEREAS, the members of SCUPP own and operate natural gas-fired <br />electric power generation facilities in California and have acted jointly, through SCUPP, <br />to, among other things, retain outside counsel to intervene at the California Public <br />Utilities Commission and Federal Energy Regulatory Commission regarding gas <br />transportation rate matters; and <br />WHEREAS, other SCPPA members, who are not SCUPP members, own <br />gas fired power generation capacity in California and have similar interests as SCUPP <br />members regarding the governmental regulation associated with power generation fuel <br />supplies; and <br />WHEREAS, the Authority is willing and able to assume the various <br />coordinated programs formerly carried forth by SCUPP and to provide to all SCPPA <br />members, on an as needed basis, all of the resources formerly afforded by SCUPP to <br />Pasadena, Glendale, Burbank and LADWP; and <br />WHEREAS, SCUPP currently has only one active contract for legal- <br />regulatory services with Hanna and Morton LLP ("Hanna"); and <br />WHEREAS, the Authority is willing and able to retain Hanna and Morton <br />LLP, and to bill all expenses and costs of retaining such consultant to the Members <br />receiving service; and <br />WHEREAS, the Board of Directors of Authority, in its Resolution No. <br />1990-15, established a revolving general fund (the General Fund) for the payment of <br />costs and expenses incurred by the Authority from time to time in carrying out its <br />purposes; and
