RESOLUTION NO. 2007-6 <br />RESOLUTION OF THE SOUTHERN CALIFORNIA PUBLIC <br />POWER AUTHORITY AUTHORIZING THE EXECUTIVE <br />DIRECTOR TO EXECUTE AN AGREEMENT WITH <br />APPLIANCE RECYCLING CENTERS OR AMERICA <br />(ARCA), AND PROVIDING FOR ADDITIONAL <br />CONTRIBUTIONS TO THE AUTHORITY'S REVOLVING <br />GENERAL FUND, AND TAKING CERTAIN RELATED <br />ACTION (RESTRUCTURING) <br />WHEREAS, the Southern California Public Power Authority (the Authority) <br />owns interests in various generation and transmission projects, the output of which has <br />been sold to Members of the Authority (Members); and <br />WHEREAS, energy efficiency programs reduce the need for additional <br />power generation facilities; and <br />WHEREAS, certain Members have a need to remove old inefficient <br />refrigerators from their systems andlor replace them with efficient refrigerators for low- <br />income customers; and <br />WHEREAS, SCPPA entered into an agreement with ARCA dated <br />pursuant to Resolution 2006-7 on July 1, 2006 for refrigerator recycling and the delivery <br />of new refrigerators to member customers, which is currently being utilized by Anaheim, <br />Colton, Glendale, Pasadena, and Riverside, for services not to exceed $300,000, and <br />WHEREAS, the Los Angeles Department of Water and Power (LADWP) <br />has requested services under the ARCA agreement not to exceed $25,000,000, and <br />WHEREAS, ARCA has agreed to amend the agreement to accommodate <br />the additional volume of services, including more favorable terms such as a lower price <br />for the delivery of new Energy Star rated refrigerators and the storage and delivery of <br />two compact fluorescent light bulbs to each refrigerator recycling customer; and <br />WHEREAS, the Authority is willing and able to (i) retain ARCA to recycle <br />inefficient refrigerators and provide replacement refrigerators to customers as directed <br />by certain Members and (ii) bill all expenses and costs of retaining ARCA to the <br />Members receiving said service; and <br />WHEREAS, the Board of Directors of Authority, in its Resolution No. 1990- <br />15, established a revolving general fund (the General Fund) for the payment of costs <br />and expenses incurred by the Authority from time to time in carrying out its purposes; <br />and
