RESOLUTION NO. 2009-111 <br />RESOLUTION OF THE SOUTHERN CALIFORNIA PUBLIC POWER <br />AUTHORITY ("SCPPA" OR "THE AUTHORITY"): (1) APPROVING THE <br />UTILIZATION OF THE PROCUREMENT RULES, POLICIES AND <br />PROCEDURES USED BY THE DEPARTMENT OF WATER AND <br />POWER OF THE CITY OF LOS ANGELES WITH RESPECT TO THOSE <br />PROJECTS WHERE THE DEPARTMENT OF WATER AND POWER OF <br />THE CITY OF LOS ANGELES IS THE MAJORITY PARTICIPANT; (2) <br />AUTHORIZING THE EXECUTIVE DIRECTOR TO CARRY OUT SUCH <br />COORDINATION AS MAY BE APPROPRIATE BETWEEN SCPPA AND <br />THE PURCHASING SERVICES DIVISION OF THE DEPARTMENT AND <br />TO ENTER INTO SUCH ARRANGEMENTS BETWEEN SCPPA AND <br />THE DEPARTMENT OF WATER AND POWER OF THE CITY OF LOS <br />ANGELES OR ITS PERSONNEL AS MAY BE APPROPRIATE TO <br />CARRY FORTH THE PROVISIONS OF THIS RESOLUTION; (3) <br />AUTHORIZING THE EXECUTIVE DIRECTOR TO TAKE SUCH OTHER <br />ACTIONS NECESSARY OR CONVENIENT TO CARRY FORTH THE <br />AUTHORIZATION CONTAINED IN THIS RESOLUTION OR AS MAY BE <br />NECESSARY TO FACILITATE THE GOALS OF THIS RESOLUTION; <br />(4) AUTHORIZING CERTAIN OTHER RELATED ACTIONS; AND (5) <br />AUTHORIZING THE OFFICERS OF THE AUTHORITY TO DO ALL <br />OTHER THINGS DEEMED NECESSARY OR ADVISABLE <br />WHEREAS, SCPPA was created in 1980 pursuant to provisions contained <br />in the Joint Exercise of Powers Act found in Chapter 5 of Division 7 of Title 1 of the <br />Government Code of California, as amended from time to time (the "Act'), by its <br />members, which are municipalities and an irrigation district that supply, among other <br />things, electrical energy, in the State of California, for the purpose of jointly and <br />cooperatively undertaking the planning, financing, contracting for, development, <br />acquisition, construction, improvement, betterment, operation, and maintenance, of <br />projects for the generation or transmission of electric energy, including programs for the <br />acquisition and delivery of secure, long term reliable supplies of renewable electric <br />energy, and also including those programs for SCPPA procurement actions necessary <br />to these projects; and <br />WHEREAS, SCPPA was established substantially through the resources, <br />efforts and foresight of the Department of Water and Power of the City of Los Angeles, <br />(the "Department' or "LADWP") in order to create a viable joint powers authority with the <br />objective of representing and carrying forth the common goals and objectives of all <br />municipally owned electric utilities, both large and small, which are situated in Southern <br />California; and <br />
